CoversX (“CoversX,” “we,” “us,” or “our”) offers a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (“Terms”). By opting in to or participating in the Program, you agree to these Terms, and Primary Privacy Policy.

Please read this agreement carefully. By joining our messaging program, you agree to resolve any disputes with us through binding, individual arbitration and you waive your right to participate in class actions, as described in the Dispute Resolution section below.


1. User Opt-In

By signing up for the Program, you agree to receive recurring automated text (SMS and MMS) messages from CoversX to the phone number you provided. These messages may include:

  • Cart reminders
  • Promotions and discounts
  • Order updates (confirmations, shipping alerts, etc.)
  • General marketing or customer support messages

You affirm that you are the authorized user of the mobile number provided and that you are opting in to receive messages from CoversX in good faith, not for the purpose of initiating legal claims.

Message frequency may vary. Message and data rates may apply. Consent is not a condition of any purchase.


2. User Opt-Out

You can opt out of the Program at any time by replying to any CoversX text message with one of the following words: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.

After you opt out, you may receive a final confirmation message. Please note that:

  • Variations or misspellings may not be recognized by our system.
  • Texting phrases like “please stop” or “remove me” may not trigger an opt-out.
  • Verbal or email requests will not be considered valid opt-outs.

3. Consent to Electronic Communications

By opting into the Program, you consent to receive required disclosures and notices from us electronically. You may request a paper copy or withdraw your consent by contacting us at [email protected].


4. Program Scope

CoversX's messaging program may include:

  • Promotions, limited-time offers, and exclusive deals
  • Abandoned cart or browse reminders
  • Order confirmations and shipping updates
  • Customer service and transactional support

Some messages may be personalized based on your previous interactions with our site or brand.


5. Use of AI in Message Content

CoversX may use trusted third-party generative AI services to assist in creating personalized message content. These tools help us tailor promotions and reminders, but all messages are sent by CoversX and not by these third-party providers. By participating, you consent to this form of AI-assisted message generation.


6. Message Frequency and Costs

We may send periodic text messages at our discretion. There is no fixed schedule or minimum frequency, and the number of messages may vary depending on your interaction with CoversX.

Standard message and data rates may apply based on your mobile carrier.

Please note: This is not a valid opt-out method. To stop receiving messages, follow the opt-out instructions in section 2.


8. Device & Carrier Limitations

Not all devices or carriers are compatible with the Program. CoversX is not liable for any delays, undelivered messages, or carrier network failures. Carrier participation and availability may vary.


9. Age Restrictions

You may only use the Program if you are 13 years of age or older. If you are between 13 and 18, you must have parental or guardian consent. By opting in, you confirm that you meet these requirements.


10. Prohibited Content

You agree not to use the Program to send content that:

  • Is unlawful, harassing, or defamatory
  • Contains obscene or offensive language
  • Violates intellectual property rights
  • Relates to protected health information (under HIPAA)
  • Is prohibited by applicable local, state, or federal law

We reserve the right to suspend access for violations of these rules.


11. State Telemarketing Compliance

Where applicable, CoversX complies with state-specific laws including:

  • Florida’s Telemarketing Act
  • Oklahoma Telephone Solicitation Act
  • Maryland’s Stop the Spam Calls Act
  • New Jersey Senate Bill 921
  • Virginia Telephone Privacy Protection Act

By providing a phone number with a state-specific area code, you consent to these terms unless otherwise notified in writing.


12. Dispute Resolution & Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY.
You and CoversX agree to resolve all disputes through binding, individual arbitration instead of in court. This means:

  • No jury trials
  • No class actions
  • Limited court involvement

Before initiating arbitration, both parties agree to attempt informal resolution by sending written notice and allowing 60 days to resolve the matter.

If unresolved, disputes will be submitted to a third-party arbitrator (e.g., New Era ADR or similar). Arbitration will be governed by the Federal Arbitration Act (FAA) and U.S. federal law.

Some small claims may still qualify for small claims court.


13. Modifications

CoversX may revise these Messaging Terms at any time. Any updates will be posted on this page with a revised “Last Updated” date. Continued participation in the Program means you accept the new terms.
